The Challenge of Food Security
At the 2009 World Summit on Food Security world leaders pledged renewed commitments to eradicate hunger by ensuring both sufficient production of and access to food for all of the world's rapidly increasing population. To that end they agreed to work to reverse the decline in agricultural investment, to improve governance of global food issues and to address the challenges of climate change to food security. The Colloquium will examine the roots of food insecurity, the mechanisms that are being adopted globally to achieve a food secure world, and the role that Australia can play in addressing the global food security challenge.

Australian International Law Journal 2010 - Call for Case Notes

Submissions of case notes for the 2010 volume of the Australian International Law Journal are now invited for consideration for publication. Submissions are particularly welcome from early career members of the International Law Association (Australian Branch). Case notes are to provide a short description of the facts and judgment, and then a longer analysis that critiques the court's holding. The word limit for any case note is 2,500 words.

Seminar - Addressing Australia's Arbitration Ambivalence
The International Arbitration Amendment Act 2010
About the Seminar: This seminar offers the first in-depth analysis of the International Arbitration Act as amended in July 2010, often going further than the 2006 revisions to the UNCITRAL Model Law on International Commercial Arbitration.
The International Arbitration Amendment Act has become the regime exclusively governing international arbitrations in Australia, arguably with no longer any possibility of opting in to the uniform Commercial Arbitration Acts (CAAs) or even a foreign arbitration law. But the CAAs are also being amended to align more closely with the Model Law, and for domestic arbitrations parties can instead opt in to the IAA regime. The CAA amendments are also interesting for provisions (eg on Arb-Med) that were not included in the amended IAA, but which may (or may not) be useful for parties to international arbitrations to adopt by agreement anyway.
This seminar explores these and many other issues affecting especially international arbitration law and practice, based primarily on the detailed introduction to the path-breaking 11-chapter work, Nottage/Garnett (eds) International Arbitration in Australia (Federation Press, october 2010: prelims reproduced at www.law.usyd.edu.au/scil).

Australia v. Japan: Proceedings at the International Court of Justice on Japan's "Scientific" Whaling
The International Law Association (Australian Branch) would like to invite you to a seminar examining Australia's case against Japan before the International Court of Justice. Australia instituted long-awaited proceedings on 1 June 2010, alleging that Japan's scientific whaling program in Antarctic waters violated the International Convention on the Regulation of Whaling, as well as its other international obligations for the preservation of marine mammals and the marine environment. Australia has also alleged that Japan is breaching its obligations under the Convention on Biological Diversity and the Convention on International Trade in Endangered Species.
This seminar will discuss Australia's possible arguments on the merits, as well as consider issues of jurisdiction, provisional measures, [the possible relevance of Australia's Antarctic claim in the proceedings] as well as Japan's potential case in reply. Speakers on these issues include:

Nygh Scholarship recipient Katie Price reports
on her internship at the Hague
INTRODUCTION: For almost 5 months I was the 2008 Peter Nygh Intern at the Hague Conference on Private International Law ('Hague Conference'). This is an organisation that for over 115 years has been dedicated to the harmonisation of cross border legal affairs and in doing so it aims to make life a little easier for those whose legal affairs do not fit neatly within the borders of one country. Whilst 115 years sounds like a ridiculously long time for a conference to be going on, the Hague Conference is no ordinary conference. Rather, it is a standing body with a Permanent Bureau that makes international laws through the consensus of its member states. 39 conventions have been concluded in that time, some that break radical new ground and others that update what has gone before to ensure these conventions keep step with the modern world. Some of the work I performed as an intern had to do with trying to get new conventions off the ground and some work dealt with maintaining and ensuring the continuing relevance of conventions. There were also a number of smaller tasks involving a variety of matters...
ILA Early Career Members Meeting
The ILA(Australian Branch) is planning to establish a committee for Early Career Members, which will be focused on holding events and pursuing initiatives that are aligned with the interests and needs of younger members of the Association. The aims also include engaging Early Career Members in the work of the Association, particularly in relation to the international law studies that are undertaken by members from Branches around the world, and seeking to establish links with or encouraging the creation of Early Career Member groups in other Branches internationally.
As an initial matter, it is proposed that a Steering Committee will be established to run various seminars or other events of interest to Early Career Members and explore opportunities for developing the involvement of Early Career Members in the ILA.
All ILA members who consider that they are in an early stage of their career or are students are invited to attend a first meeting to establish the Steering Committee and canvas the first steps that may be taken for this endeavour.
The ILA has also invited James Pender to speak on his recent experiences of internships at the ICTY, ICC and Special Court of Sierra Leone; undertaking his LLM in international law and the process of applying to "the right" university depending on your career aspirations; and working in a firm overseas doing public international law cases.
The meeting will be held on Wednesday, May 5, at 7pm. Marque has kindly agreed to host the event at their premises:

International Investment Treaty Law and Arbitration: Evolution or Revolution in Substance and Procedure
A conference on "International Investment Treaty Law and Arbitration: Evolution or Revolution in Substance and Procedure?", is being hosted by the University of Sydney on 19-20 February 2010. ILA is one of the supporting organisations of the conference.
A full programme of around 60 speakers from private practice, government and academia, will address developments in substantive and procedural issues in investment treaty law and arbitration. A number of panels will focus on various cross-cutting themes, including the interaction between foreign investment law and policy with international commercial arbitration, WTO law, environment and development issues, human rights law, and the Asia-Pacific.
Our keynote speaker is Professor Philippe Sands QC (University College London and Matrix Chambers), and our Distinguished Speakers are Sir Franklin Berman QC (Essex Court Chambers) and Professor Sornarajah (National University of Singapore).

Nygh and Brennan prizes in International Law
The International Law Association (Australian Branch) is calling for submissions for the Nygh Prize in Private International Law and the Brennan Prize in Public International Law. The closing date for submission of entries is 22 December 2009. Entries should be submitted by email only to the President of the Australian Branch, Dr Christopher Ward, at cward@12thfloor.com.au.
These two prizes, named in honour of the late Dr Peter Nygh, a leading Australian scholar of private international law, and Sir Gerard Brennan, former Chief Justice of Australia and Patron of the Branch, are awarded to the authors of essays in the field of Private International Law (Conflict of Laws) and Public International Law, respectively, which demonstrate outstanding scholarship and make a distinct contribution to an understanding of the subject. The prize is open to any Australian citizen, or person normally resident or studying in Australia. The competition is intended to recognize and encourage achievement by a student, or younger scholar or practitioner of law. Essays submitted for consideration for the Prize should be between 4,000 and 7,000 words in length, and written in 2009. They may have been submitted previously for course credit in an academic institution. Essays which comprise an answer to a hypothetical problem question are not eligible.

Members of the Branch who would like to put their names forward as potential nominees to international committees of the ILA are requested to send the following to Andrew.Byrnes@unsw.edu.au by 30 September 2009:
(a) a curriculum vitae;
(b) a brief statement of your expertise in the particular area and your likely contribution to the current project of the committee/study group for which you would like to be considered.

The process of consideration of nominations has two stages :
(a) ILA (Australian Branch): a sub-committee of the ILA (Australian Branch) considers expressions of interest and makes recommendations to the Management Committee, which decides on which names should be put forward to the Director of Studies in London; and
(b) ILA headquarters: the Director of Studies will consult with the Officers of the committee concerned before making a recommendation to the Executive Council.
A nomination by a Branch is not always forwarded to the Executive Council, for example because the Committee’s work is well-advanced and the Chair considers that it is not appropriate to add new members at a particular time. It may therefore advisable to get in touch informally with the Chair of the Committee or with existing Australian Branch members if you are interested in to see whether the addition of new members is possible. Results of the Brennan Essay Prize Competition
The lnternational Law Association (Australian Branch) is delighted to announce that this year's Brennan Prize for Public International Law has been won by Hernan Pintos-Lopez, who wrote on the topic of humanitarian intervention in Darfur.
The overall standard of entires was simply excellent, and the jury was excited to see such quality scholarship from so many young scholars. The President will be writing to the winner, together with a number of other entrants, with a view to suggesting publication of their work in the Association's Journal. Nygh & Brennan Prize Announcement

There were 20 entries, all of which were of excellent standard, and which covered an extensive field of topics. The jury found the decision extremely difficult. The Association intends to invite a number of entrants to submit their work for future publication.
I thank all the entrants, and extend an invitation to consider joining the Association to further their interests in public and private international law.
The winners will receive a certificate, a year’s membership of the International Law Association, and cash in the amount of $300.

Call for entries for Nygh & Brennan prizes in International Law
The International Law Association (Australian Branch) is calling for submissions for the Nygh Prize in Private International Law and the Brennan Prize in Public International Law. The closing date for submission of entries is 19 December 2008. Entries should be submitted by email only to the President of the Australian Branch, Dr Christopher Ward, at cward@12thfloor.com.au.
These two prizes, named in honour of the late Dr Peter Nygh, a leading Australian scholar of private international law, and Sir Gerard Brennan, former Chief Justice of Australia and Patron of the Branch, are awarded to the authors of essays in the field of Private International Law (Conflict of Laws) and Public International Law, respectively, which demonstrate outstanding scholarship and make a distinct contribution to an understanding of the subject. The prize is open to any Australian citizen, or person normally resident in Australia or studying in Australia. The competition is intended to recognize and encourage achievement by a student, or younger scholar or practitioner of law. Essays submitted for consideration for the Prize should be between 4,000 and 7,000 words in length, and written in 2008. They may have been submitted previously for course credit in an academic institution. Essays which comprise an answer to a hypothetical problem question are not eligible.

Citizen of the World wins International Law Award
Katherine Price is the 2008 winner of the Peter Nygh Hague Conference Internship. The formal presentation of the award will take place on Thursday June 26 at the offices of Allens Arthur Robinson in Sydney at 6.30pm.
Katherine Price has a deep interest in private international law, particularly conflicts of law and cross border legal co-operation in family law. She describes herself as 'a citizen of the world.' Katherine graduated with the combined degrees of Bachelor of Laws and Bachelor of Arts (International Studies) from the University of Technology, Sydney with honours in law having completed a research thesis on Recognition of Foreign Same Sex Marriages in Australia: A Scandalous Affair. Her research thesis drew on, amongst other things, the work of Dr Nygh. Katherine has been accepted by The Hague Academy of International Law to undertake their very prestigious 2008 summer school programme in public and private international law. After completing the summer school Katherine will commence a 6 month internship with The Hague Conference on Private International Law. Katherine has also accepted the position of Associate to Justice Peter Graham of the Federal Court of Australia for the calendar year 2009. Katherine is currently working as a paralegal with Gilbert + Tobin Lawyers where she has accepted a graduate position to commence in 2010.

Call for expressions of interest or nominations for membership of proposed new Study Group on Sovereign Insolvency and Advisory Committee on Research

The Director of Studies of the ILA, Professor Christine Chinkin, is currently considering a proposal for the establishment of a Study Group on Sovereign Insolvency. If you have expertise in this area and would like to have your name considered for this Study Group (initially by the Australian Branch, then by the Director of Studies and the Executive Council), or wish to suggest someone for membership, please let Andrew Byrnes (Andrew.Byrnes@unsw.edu.au) know by 22 March 2008. Further details of the proposed mandate of the Study Group can also be obtained from Andrew Byrnes. New Guidelines on membership of committees and study groups were adopted by the Executive Council in November 2007 and can be found at http://www.ila.org.au/committees_international.htm (Annex B).
Professor Chinkin also proposes the election later this year of new members of the Advisory Committee on Research. Suggestions of possible nominations from the Australian Branch should be sent to Andrew Byrnes (Andrew.Byrnes@unsw.edu.au) by 31 March 2008.

In the lead-up to the Rio conference of the ILA later this year, the Director of Studies of the ILA, Professor Christine Chinkin, has called for proposals for new committees and study groups. In addition to a likely new Study Group on Sovereign Insolvency, Professor Chinkin has suggested that it might be appropriate to establish new committees on international aspects of health law, or environmental law -- and is open to other suggestions.
If you have ideas about possible new committees, please let Andrew Byrnes (Andrew.Byrnes@unsw.edu.au) know by 31 March 2008. It would be very much appreciated if proposals for new committees could include a brief outline of 1-2 pages setting out the need for the proposed committee and the work that such a committee might undertake.

"Security, Scarcity, Struggle: The Dilemmas of International Law"
The theme of this year's Conference reflects a number of debates (or struggles) occurring in public international law. The field is fragmenting, to be sure, but at every turn similar dilemmas arise. In a world marked by increasing scarcity and insecurity, does international law need to be reconfigured to accommodate or confront the threat of hegemony, or to realise the promise of justice (or kindness), or to facilitate the redistribution of resources (or the operation of the market), or to reconcile the imperatives of economic well-being (or gross over-consumption) with the salvation of planetary life? If so, what role ought we, as international lawyers, play in ordering, reordering or reimagining the global commonwealth?
Accordingly, the Conference Organising Committee now calls for proposals for papers to be presented at the 16th Annual Conference. Special consideration will be given to proposals which seek to develop the Conference theme in one or more of the following areas:
- the meaning of security (military, human, state) in contemporary international law;
- the struggle over international law and human rights in national courts (Al Jedda, Al Skeini, Hicks, Hamdan, Boumediene);
- current issues for international law (including those arising from the war on terror, the protection of whale stocks, poverty, gender, global climate change, disarmament and nuclear proliferation);
- the protection of the global environment and prevention of global warming in the context of inequality and the "carbon debt"?
- the role of international institutions, international lawyers and civil society in promoting or ameliorating injustice (e.g. Australian Government's proposal to bring Iran to the International Court of Justice).
A range of journals have expressed interest in receiving submissions of conference papers for consideration for publication including, the Australian Yearbook of International Law, the New Zealand Journal of Public and International Law, the New Zealand Yearbook of International Law and the Australian International Law Journal. Conference papers will also be published (unedited and unrefereed) in a new International Papers database to be established by Austlii at www.austlii.edu.au.
The Organising Committee encourages proposals which present collaborative research amongst Society members and/or which focus on the role of international law in the Asia-Pacific region. Recently-appointed academics, in particular, are encouraged to send proposals. Post-graduate students and those wishing to present on their post-graduate thesis work are encouraged to submit their proposals for the Post-Graduate Workshop to be held immediately prior to the Conference on 25 June 2007.
A one page abstract and a one page resumé should be submitted to the Organising Committee by Friday 7th March 2008 by email to the Conference Administrator: Kavitha Robinson at cipl@law.anu.edu.au.

Nils Melzer, Legal Adviser for the International Committee of the Red Cross (ICRC) has considerable expertise in the field of International Humanitarian Law.
Dr Melzer has worked as an ICRC field delegate in the Balkans and the Middle East, and as legal adviser to the operations department at ICRC Headquarters in Geneva. Since 2004, he has been responsible within the ICRC's Legal Division for an expert process aimed at clarifying the law relating to the increasing trend of civilians participating in hostilities. In 2006, he completed a doctoral thesis on targeted killings.
In his talk, Dr Melzer will discuss the problem in contemporary armed conflicts of distinguishing civilians who 'directly participate in hostilities' from 'peaceful' civilians and the consequences of this distinction for the protection of civilians from direct attack.

Dr Kriangsak Kittichaisaree is Ambassador at Large in the Ministry of Foreign Affairs of Thailand and is recognised as a leading international criminal lawyer. He was involved in negotiations for the International Criminal Court and is the author of International Criminal Law (Oxford University Press, 2001), one of the definitive texts in the area. Dr Kriangsak has an LLM from Harvard and a PhD from Cambridge, and is an Adjunct Professor at UNSW Law School. The Convention on the Prohibition of the Development, Production, Stockpiling and use of Chemical Weapons and on their Destruction entered into force in 1997. Bimal Patel, has been a staff member of the organisation for the Prohibition of Chemical Weapons in The Hague since 1995. He has a Masters degree in Public International Law from the University of Leiden and an MA (International Relations) from the University of Amsterdam. He has been a visiting professor at various universities in Europe and Asia and has published on disarmament and the International Court of Justice. He will speak on the role of the OPCW in implementing the Chemical Weapons Convention and will discuss the broader implications of the success of this treaty for international peace and security.

Led by Milos Barutciski, President of the Canadian Branch, the Organising Committee is already making excellent progress with arrangements for the event. Justice Michael Kirby - The High Court of Australia
Presents; The 2005 Annual Charteris Lecture
“The Universal Declaration on Bioethics and Human Rights”
No Australian judge in office has given such attention to international law in his decision-making as Justice Michael Kirby of the High Court of Australia. This attention preceded his appointment to the High Court. In his earlier service in the Australian Law Reform Commission, he drew on international law and likewise in the NSW Court of Appeal.
Justice Kirby has just returned from chairing the UNESCO Committee that drafted the proposed Universal Declaration on Bioethics and Human Rights. He will describe the process and explain his conviction that the global developments of human rights will not pass Australian law by; but will increasingly influence the directions of our law, overcoming initial insularity and hostility.
