The recent High Court decision in the Kingdom of Spain v Infrastructure Services Luxembourg case has stimulated much discussion concerning the extent and nature of Foreign State immunity, the operation of the ICSID Convention and even the attractiveness of the Australian courts in comparison to courts in other nations handling similar matters.
